The National Retail Association has developed the Workplace Investigations Masterclass – a half-day intensive workshop.

So you need to look into the conduct of an employee, but don’t know where to start. The ability to carry out an effective workplace investigation is fast becoming an essential skill for any business owner, manager, or HR professional.

The Fair Work Commission is losing patience over defective investigations, and they are now becoming the difference in unfair dismissal cases.

“The decision was ‘unsound, indefensible and ill founded’ and based entirely on a hopelessly flawed investigation.” Horan v Tren Trading Pty Ltd [2019] FWC 3249 per Sams DP

In consultation with leading workplace relations practitioners, the National Retail Association has developed the Workplace Investigations Masterclass – a half-day intensive workshop where participants will obtain hands-on experience by conducting their own mock investigation.

Whether you are new to workplace investigations, or simply want to keep up-to-date with best practice, the Workplace Investigations Masterclass is tailored to suit all skill levels. The workshop will cover the rules of engagement for investigators, as well as practical skills including:

  • drafting clear and concise letters of allegation;
  • effective interviewing techniques; and
  • dealing with misconduct during the investigation.

All participants will receive complimentary resources for use in their own investigations, including three template letters and a template investigation report, normally priced at over $750 (over 50% off).

“While it is true that procedural defects will not necessarily render a dismissal unfair, in this case I am satisfied that the lack of an appropriate investigation and the involvement of Mr Snook in the investigation means little confidence can be had in the investigation process (as it was). This casts substantial doubt over the outcome of that process.”

Emery v City of Stirling [2018] FWC 6853 per Bissett C
